This
is a story about San Antonio city government's
use of municipal huff and puff, and bluster and
blunder, to intimidate and deprive at least one
citizen of his rights.
It's
probably an example of illegal intimidation, too.
To
wit:
Title
18, USC., Section 242
Deprivation of Rights Under Color of Law
This statute makes
it a crime for any person acting under color of
law, statute, ordinance, regulation, or custom to
willfully deprive or cause to be deprived from
any person those rights, privileges, or
immunities secured or protected by the
Constitution and laws of the US.
This law further
prohibits a person acting under color of law,
statute, ordinance, regulation or custom to
willfully subject or cause to be subjected any
person to different punishments, pains, or
penalties, than those prescribed for punishment of
citizens on account of such person being an alien
or by reason ofhis/her color or race.
Acts under
"color of any law" include acts not
only done by federal, state, or local officials
within the bounds or limits of their lawful
authority, but also acts done without and beyond the
bounds of their lawful authority; provided that,
in order for unlawful acts ofany official to be
done under "color of any law," the
unlawful acts must be done while such official is
purporting or pretending to act in the
performance of his/her official duties. This
definition includes, in addition to law
enforcement officials, individuals such as Mayors,
Council persons, Judges, Nursing Home
Proprietors, Security Guards, etc., persons who
are bound by laws, statutes ordinances, or
customs. (Emphasis added.)
Punishment varies
from a fine or imprisonment of up to one year, or
both, and if bodily injury results or if such acts
include the use, attempted use, or threatened use
of a dangerous weapon, explosives, or fire shall
be fined or imprisoned up to ten years or both,
and if death results, or if such acts include
kidnapping or an attempt to kidnap, aggravated
sexual abuse or an attempt to commit aggravated
sexual abuse, or an attempt to kill, shall be
fined under this title, or imprisoned for any
term of years or for life, or both, or may be
sentenced to death.

When contacted by RG Griffing, Anita
Ramirez of Chief McManus office said this letter does
not exist. When told Griffing was a reporter she
became angered, Which begs the question -- do media
get a different answer than mere citizens?

As
noted in this space on more than one occasion, there
are serious questions about the 911 emergency
services supposed to be provided by the city of San
Antonio.
Recently
the Express-News shed some light on this.
Top
SAPD and city information technology leaders
acknowledged problems but said they were
being resolved. They denied there was
widespread discontent with the system. In no
way does it compromise public safety or
endanger officers, and to suggest such a
thing is irresponsible, they said.
But
the reviews from those who use it have been
less than stellar.
If
this were the private sector, heads would
have rolled months ago, one officer
said. Another cited as a recent example a
check run on a man's name to see if he had
any arrest warrants. The new system showed
none. But the old mainframe, which still can
be used, revealed he was wanted on a
weapons charge.
Officers
can't even do the basic things,
police union President Mike Helle said,
adding that most officers are beyond
frustrated at the system's lack
of operability.

At
least two police insiders believe Chief McManus and
Michael Bernard are retaliating for Foddrill's
accusations of fraud and theft. Those same insiders
say they have seen documentation supporting Foddrill.
Others say McManus quietly passed the word not to
speak to or about Foddrill. Bernard has used the same
tactic on city workers.
Meanwhile,
the Chief and City attorney have issued an edict
banning Foddrill from the city for no stated purpose.
Then they sent armed policemen to Foddrills home on
the night of July 4th.

Police
have ignored documented threats against Foddrill. and
an assault against an involved party.
