In Spite of a "screw up" by a City contractor who delivered notices for a recent brush pick up two days too late, SA residents could still face a $2,000 fine over "illegal" trash, if the City so decides.

Their fault. You pay.

Let me explain.

Even as SA Mayor "Two-Dogs" Garza was riding about in a trash truck Monday to demonstrate the proper way to pose for the camera and to package your trash, a City paid contractor charged with the task of delivering brush-hauling notices fumbled that job.

Legally mandated paper work, advising residents when to put out rubbish for pick up, arrived two days after the City had already made its rounds, confusing some recipients on the Southside, and inadvertently placing them in jeoporady of violating the Draconian City brush ordinance.

The City now only makes two such runs each year, because of the costs, they say.

Put your brush out at the wrong time, and you risk a hefty criminal fine.

At least 200 residents around East Palfrey in Highland Hills were left dangling, along with the tardy notices on their door knobs, when the hangers finally showed up on Wednesday.

"I don't know what the hell is going on," one resident complained to this column.

Neither, it seems, does the City.

"We're really not sure what happened," City supervisor Marty Perez told the Lightning when queried about the foul up. Perez said that even though the late, undated notices say "Monday, " more likely a second brush collection will take place "during next week, but probably not on Monday. We have prior commitments."

Do not place brush and bulky items out for collection unless you have been notified by the City that brush collection will be in your area!

If brush and other items are placed in your yard and you are not eligible for brush collection, you are considered in violation and may receive a fine of up to $2000 plus be billed for the collection and disposal of these items.

Confusing? It gets worse.

City contractor Alternative Delivery Systems (ADS) is refusing comment on the fubar, though the Lightning has learned that an internal company investigation is aimed towards blaming at least one of the ADS subcontractors.

But ADS ain't talkin'.

Despite the fact that City employees had referred us to ADS, ADS referred us back to the City.

ADS is apparently practicing the fine art of CYA. Or maybe it's the City playing that tired and true tactic.

ADS honcho Gary Grimes told the Lightning, "you're not getting anything out of me!" Indeed, we did not, except for that quote.

But we did learn from insiders that this is not the first such mistake involving ADS. How many such mistakes...no one seems to know; or more accurately, no one seems to want to say.

You would think that this fiasco would let those who were confused by the ordeal off of the legal hook. But not so, necessarily.

An SA superintendent, Cayo Gaigan, confirmed the screw up, but said any code violation caused by the confusion would have to be "looked at."

With a $2,000 fine (per day) in the offing, that could become a serious problem for local residents. Or at least an unwarranted concern.

Questions remain.

Who pays for the second round of brush pick up?

The answer, of course, is YOU.

Will ADS be held to account? We will see.

Will such incompetence surface again?

Probably.
